Welcome to Gymtricks LLC. By accessing or using our website at gymtricks.app (the "Site") and our children's gymnastics training and sports preparation services (the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Site or Services.

These Terms constitute a legally binding agreement between you ("you," "your," or "User") and Gymtricks LLC ("Company," "we," "us," or "our"). By using our Services, you represent that you have read, understood, and agree to be bound by these Terms.

2. Description of Service

Gymtricks LLC provides children's gymnastics training, sports preparation programs, and related fitness services. Our Services include, but are not limited to:

• Preschool gymnastics programs for children ages 3-5
• Youth gymnastics training for children ages 6-12
• Advanced gymnastics training for athletes ages 10 and up
• Sports preparation and conditioning programs
• Flexibility and balance training
• Group classes and private instruction

Location: Our Services are provided at our facility located at 1220 N BRAZOS ST, Whitney, TX 76692, and may include online resources, scheduling tools, and informational content through our website.

3. Eligibility

Parental/Guardian Enrollment Required: Our Services are designed for children and minors. Only parents, legal guardians, or authorized adults over the age of 18 may enroll children in our programs. By enrolling a child in our Services, you represent and warrant that:

• You are the parent or legal guardian of the child, or you have been authorized by the parent or legal guardian to make decisions regarding the child's participation
• You have the legal authority to bind the child to these Terms
• You are at least 18 years of age
• All information provided about the child and yourself is accurate and complete

We reserve the right to request proof of guardianship or authorization at any time. Failure to provide such proof may result in termination of Services.

Health Requirements: You represent that the child enrolled is physically and mentally capable of participating in gymnastics and sports activities. You agree to inform us of any medical conditions, disabilities, or special needs that may affect the child's participation.

4. User Responsibilities

As a User of our Site and Services, you agree to:

• Provide accurate, current, and complete information during registration and enrollment
• Maintain the confidentiality of any account credentials or login information
• Promptly update your account information if changes occur
• Ensure that children arrive on time and are picked up promptly from scheduled sessions
• Inform our staff of any changes to the child's health, medical conditions, or emergency contact information
• Follow all facility rules, safety guidelines, and staff instructions
• Treat our staff, other participants, and visitors with respect and courtesy
• Use our website only for lawful purposes and in accordance with these Terms
• Pay all fees and charges associated with enrolled programs in a timely manner

5. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

To the fullest extent permitted by law, Gymtricks LLC disclaims all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding the accuracy, reliability, or completeness of any content
• Warranties that the Site will be uninterrupted, error-free, or free of viruses or other harmful components
• Warranties regarding the results that may be obtained from using our Services

Physical Activity Disclaimer: Gymnastics and sports training involve inherent risks of injury. While we take all reasonable precautions to ensure participant safety, we cannot guarantee that injuries will not occur. Participants engage in physical activities at their own risk. Results vary based on individual participation, physical ability, and commitment. We do not guarantee specific athletic outcomes or skill levels.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GYMTRICKS LLC AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES.

Our total liability for any direct damages arising from the Site or Services shall not exceed the amount you paid, if any, for access to the Site or participation in the specific program giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

7. Termination

We reserve the right to terminate or suspend your access to the Site and Services at any time, without prior notice or liability, for any reason, including but not limited to:

Upon termination, your right to use the Site and Services will immediately cease. You may terminate your account or withdraw from programs by contacting us at support@gymtricks.app.

8. Governing Law

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict of law provisions.

Jurisdiction: Any legal action or proceeding arising under these Terms will be brought exclusively in the state or federal courts located in Hill County, Texas, and you hereby consent to the personal jurisdiction and venue therein.
